Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The “Maqui Superberry Patagonia Cruise” Sweepstakes (the "Sweepstakes") will begin at 12:01am Eastern Daylight Time (EDT) on Wednesday, April 1, 2009 ("Sweepstakes Start Date"), and end at 11:59pm (EDT) on Wednesday, December 31, 2009 ("SweepstakesPeriod"). Sweepstakes is sponsored by: the Novelle International, Inc. 707 24th Avenue West, Bradenton, FL 34205 (the "Sponsor").
ELIGIBILITY: Sweepstakes is open only to individuals who are (i) legal residents of the United States and District of Columbia (excluding Rhode Island); (ii) 18 years of age or older as of “Sweepstakes Start Date”. Employees, officers and directors of Sponsor, its parent company, affiliates, subsidiaries, agents and advertising and promotion agencies, (collectively including Sponsor, “Sweepstakes Entities”) as well as the immediate family members (parents, children, siblings, spouses) and/or persons living in the same household (whether related or not), are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. Void where prohibited.
TWO WAYS TO ENTER 1.) Purchase a Maqui Superberry liquid supplement at one of our distributors; through one of our affiliates; or online at http://www.maquisuperberry.com. To participate in the Sweepstakes, go to www.maquitrip.com and complete the registration entry form. You will be required to include the Maqui Superberry bottle’s UPC code. If an order is placed for a company, the person placing the order shall be the individual entered in the Sweepstakes. All online orders and online entries must be received by 11:59 pm EDT on December 31, 2009. Online entrants must have a valid email address. In NY and FL retail locations, which can be found on www.maquitrip.com, you may register in the store. 2.) To enter by mail, without the purchase obligation, you must hand print the name of the Sweepstakes, your name, address, city, state, zip code and day and evening telephone numbers with area code, and if available, your email address on a 3-1/2 " x 5 " postcard size and mail it in a first class stamped envelope to: “The “Maqui Superberry Patagonia Cruise” Sweepstakes c/o 90 Rockwood Place. Rochester, NY 14610. Entry must be received by December 31, 2009. Limit is one (1) entry per person regardless of the method of entry. By participating, you consent for Sponsor to obtain, use, and transfer your name, address and other information for the sole purpose of administering this Sweepstakes. Sweepstakes Entities are not responsible for: lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, misdirected, stolen, postage-due registrations, entries or mail. Sponsor reserves the right to disqualify any person or e-mail address that submits more than maximum allowed entries. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.
INTERNET LIMITATIONS OF LIABILITY: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of or after (if applicable) this termination or suspension date. Sweepstakes Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sweepstakes Entities are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
GRAND PRIZE: One (1) Grand Prize Winner will win an all-inclusive cruise for 2 to Patagonia, Chile. The trip includes round trip tickets for 2 from NYC or Miami to Chile, plus the all-inclusive 5 days, 4 nights cruise. Winner and travel companion must have valid passports, subject to current U.S. and Chile’s Customs requirements. Winner’s travel companion will be required to sign and return a Liability/Publicity Travel Companion Release not less than thirty (30) days before departure date or will not be permitted to accompany winner on trip. If the travel companion is a minor, the parent or legal guardian must sign and return the required liability/publicity release (see requirement below) and Winner must be the minor’s parent or legal guardian. Other port of entry and/or customs requirements/fees may apply and it is the responsibility of the Grand Prize Winner and Winner’s companion to satisfy any such requirements, as necessary. Winners will receive a travel voucher from a third party travel agency to book the travel arrangements. There are no booking fees. Winner and travel companion must book and travel on same itinerary. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. The total value of the airfare, hotel accommodations, and vacation extras cannot exceed $5,000. The trip must be completed by April 30, 2010 or prize will be forfeited. Prize is subject to promotional availability. Prize suppliers will make every effort to confirm reservations as requested, however, travel and accommodations are subject to capacity controls, availability, blackout dates and other restrictions, all of which are subject to change and may not be in Sponsor’s control. All other expenses associated with this trip are the responsibility of the winner to pay, including all tips, gratuities, service charges, taxes, meals not included in the initial itinerary, ground transportation not specified, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, local and long-distance telephone calls and any other incidental costs or expenses not identified in these Official Rules. Winner must comply with any and all applicable federal, state and local laws. The value of the Grand Prize is taxable as income, and all local, state and federal taxes are the exclusive responsibility of the Grand Prize winner.
DRAWING AND NOTIFICATION: The potential Grand Prize Winner will be selected from among all eligible entries received, in a random drawing conducted, on or about January 14, 2010 by the Sweepstakes Administrator, an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. Potential winner will be notified by phone and mail. Upon initial notification and verification of potential winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor’s choice.
PRIZE CONDITIONS: Each winner is required to comply with any and all applicable federal, state and local laws, rules and regulations including, but not limited to licensing and insurance requirements. All applicable tax, title, registration, shipping, accessories and licensing fees are the sole responsibility of the winner. The value of the Prize is taxable as income and the Winner is solely responsible for all matters relating to the Prize, including, but not limited to all applicable federal, state and local taxes that become due with respect to the Prize. Final actual value at time of booking and travel may be substantially more or less depending on dates of travel, point of origin and ticket availability. The winners will be required to sign an Affidavit of Eligibility and Liability/Publicity Release, and return it within 14 days of written notification. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if potential winner fails to return requisite document within the specified time period, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and, an alternate winner may be selected for the prize at issue. All taxes, if applicable, are the sole responsibility of the winner. The winner’s entry and acceptance of the prize offered constitutes permission (except where prohibited) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
TERMS AND CONDTIONS: This Sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless the Sponsor, vendors associated with the Sweepstakes, and the respective officers and employees of these entries, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in this Sweepstakes. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the full extent of the law. This Sweepstakes is void where prohibited.

VT & WA residents may omit return postage.
